Licensing Act 2003 Application for a New Premises Licence for The Spiritualist, 25 St John Street, Lichfield, WS13 6NU

Minutes:

The Committee heard evidence from the Applicant that they had agreed further conditions with the Police and as a result there were no objections from that Responsible Authority. They also notified the panel that they wish to amend their application to remove off sales as this was not required. The Applicant expressed that the premises would not be a vertical drinking establishment and would have seating offering cocktails, craft beer, and street foods. Further, that there would be no patrons congregating outside to the front of the building as there was an enclosed smoking area to the rear of the building. This was naturally acoustically screened, and supervision to ensure patrons were directed to this and not allowed to congregate at the front, in the event that functions or events would take place there would be adequate - SIA licensed door supervision.

 

Representations were then received from interested parties, local neighbours, referring to possible antisocial behaviour from litter, noise, broken bottles and problems with parking. They also had concerns of public safety due to the narrowness of the pavement outside the venue. They also felt there was an increased possibility of elderly residents feeling intimidated by patrons entering and leaving the venue.

 

DECISION

 

The decision of the Panel having regard to the evidence submitted that the Premises  Licence be granted subject to the Licence Conditions detailed within the report including conditions as agreed with the Police, as responsible Authority, there are to be no off sales.

 

The reason for the decision was as follows:

 

There was insufficient evidence that any of the four licencing objectives, the prevention of crime and disorder, public safety, the prevention of public nuisance  and the protection of children from harm, would not be met.

 

Each party has the right to appeal this decision within 21 days to the Magistrates Court.
