Exclusion of Public and Press

RESOLVED: “That as publicity would be prejudicial to the

public interest by reason of the confidential nature of the

business to be transacted, the public and press be excluded

from the meeting for the following items of business, which

would involve the likely disclosure of exempt information as

defined in Paragraphs 3 and 5 of Part 1 of Schedule 12A of the

Local Government Act 1972”

Friarsgate

Friarsgate (report attached).

 

Council is to decide whether to terminate the Friarsgate Development Agreement should key milestones highlighted in the development agreement not be achieved by the due date. Council will consider the information including extracts from the development agreement, other agreements, financial implications and legal advice. Council will also consider the implications of the decision to end the Development Agreement on the council’s Medium Term Financial Strategy.    

The report contains significant financial information relating to the interests of the council and other parties. In consequence, this report is to be considered in private as permitted by paragraph 3, Part 1 of Schedule 12A of the Local Government Act 1972 on the grounds that the report contains information relating to the financial or business affairs of any particular person (including the council).

The report also contains advice from the council’s legal advisors. In consequence, this report is to be considered in private as permitted by paragraph 5, Part 1 of Schedule 12A of the Local Government Act 1972 on the grounds that the report contains information in respect of which a claim to legal professional privilege could be maintained in legal proceedings.
